CONTRACT TERRITORY

The general business conditions (GBC) of ARPLUS AG are valid for all business activities and services related with AMORAI products, generated by ARPLUS AG.

PRICES & VAT SWITZERLAND

All prices shown are net prices, in Swiss Francs (CHF), exclusively VAT.
For customers with billing address in Switzerland the invoicing is in Swiss Francs.
The Swiss VAT of 7.6% is applied on net-prices, when billing a Swiss address.
The published prices are valid until further notice. Prices being changed without prior notice. We can not be claimed for false prices issued by mistake.

PRICES & VAT EU / OTHERS

All prices shown are net prices, in EURO (EUR), exclusively VAT.
For EU- customers, ordering in Switzerland, the invoicing is in EURO.
For EU- private customers, ordering in Switzerland, the invoicing is in EURO. For private cusomer orders from EU, the specific VAT is applied to the net prices, according the country, where the goods are imported. For customer with a valid VAT- identification-number, VAT is not billed.
For orders outside EU, the goods are delivered without VAT.
The published prices are valid until further notice. Prices being changed without prior notice. The key currency is the EURO. Changes the exchange ratio of of other currencies (e.g. Swiss Franc) to te EURO, it will by addapted.

CUSTOMS DUTIES ( delivery from Switzerland to EU)

Min. 40 CHF (Swiss Francs) are the custom duties and put on the clients bill. Any shipment, whether small or big, has to pass the customs. Our logistic partner offers a customs service and the costs are passed to customers account.

PACKAGING

Ordering a sole article: When ordering a sole article a packaging fee of 3.00 CHF (Swiss Francs) is applied for the cardboard box. For shipments in envelopes/air cushion envelopes min 1.00 CHF is charged, or according expense.
Ordering several articles: 3.00 CHF/ cardboard box is charged. According to quantity and size of the ordered articles a reasonable amount and size of cardboard boxes will be chosen.
Cardboard boxes well reused: We encourage the idea of re-using cardboard boxes, when forwarding goods. It is possible that your goods will be transported in a re-used cardboard box, – which has bean cleaned inside and controlled by us. This way we contribute to a proper environment and save higher packaging costs to he client.
When using EUR pallets for consignment of goods we ask for EUR- pallets for exchange. If „One Way“ pallets are requested, we do supply against net costs.
All goods are additionally packed/ wrapped in paper or in a plastic bag, before placed into the cardboard box. If not necessary, we do not use plastic bags for packaging, but apply environment- friendly materials, as long as asked from the clients. We do follow client suggestions, when previously fixed in written form.

RECEIVING OBLIGATION

The logistic company, which is delivering the parcels to the client, needs a valid phone or mobile number. The telephone access to the client must be guaranteed. The client or a person of his trust must be reachable at the specified address. The order is handed over to the client only against signature.
The logistic company will try three times (3x) at the maximum to contact the client. If contacting was unsuccessful, the freight will be returned to us. The freight-charges will be debited to the client.
Post-office box address will not be accepted.
We kindly ask the AMORAI clients, to complete the order/contact form. Costs, generated by not possible delivery of the goods will be charged to the client.

FORWARDING CHARGES

We cooperate with national and international logistics companies when sending you goods. For their forwarding services their general business conditions are valid. When sending goods from Switzerland to other countries customs duties are charged to the customer. For wrong delivery we take the costs.
Delivery within Switzerland: goods are sended with lowest costs possible, despite the customer specifies an extra quick delivery.
Abroad delivery: goods are sended with lowest costs possible, despite the customer specifies an extra quick delivery.

PAYMENT

We do ask for prepayment for ordered goods. We send you the invoice with the payment order so you can pay it easily from home by using your internet banking. We abandon cash on delivery since more costs are generated to all involved. For the time being we also do not accept payments with credit card. Bank fees for the money transfer are paid by the client. ARPLUS AG remains owner of the goods until goods are completely paid.

CORRECT INFORMATION DUTY

The client is obliged, when ordering, to supply correct information. The client has to make sure, that his e-mail address is active and accessible. When our e- mail is rejected several times, we feel free not to accept the order. In any case we need the valid telephone number, where the customer can be reached at any time, when delivery should be done and the logistics company needs to contact the client.

DISCLAIMER / REPLACEMENT / DAMAGES

Damages:
Content of parcel: The customer is obliged immediately after receiving the parcel to control the goods regarding amount and visible damages and to write them down on the invoice/letter of delivery and send the information by return to us.
Damages during transportation: Visible from outside damaged parcels have to be controlled right away with the forwarding company. The client has to check whether products inside have been damaged or soiled and to report in written form to us by return.
Disclaimer/ Replacement of Swiss orders: The client has the right to return the ordered goods within 14 days after receiving them to us. The goods must be returned in the original packaging, unused, proper. No reason must be named, why goods are returned. The return must be previously announced in written form to us, otherwise the return will not be accepted. The return of goods is not valid for models, where the customer has ordered a article created by the customer. The transportation costs for the return are paid by the customer. After the incoming, the goods we will controlled to damages and contamination. Is the return proper, the paid amount, inclusively VAT, exclusively transportation costs will be returned to the client.
The payment will be done by electronic banking. Please supply all necessary information for the money transfer (name, address, bank address, account number, IBAN, SWIFT) If necessary information is missing, we will take no efforts to contact the customer and ask for the missing data. It is in the interest of the client supplying necessary information for money transfer. Banc/transfer fees will be debited to the client, respectively will be subtracted from the amount sent.

Disclaimer/ Replacement of abroad orders (outside Switzerland):
By disclaimers and replacements of abroad orders, only the amount of the ordered goods will be returned. Customs duties can nor be refund. Also all fees of the money transfer will be subtracted from the amount sent. All other conditions valid like in chapter “ Disclaimer/ Replacement from Swiss customers”.

GUARANTEE

To all AMORAI articles a guarantee of 12 months is given on latent defects. The guarantee is covering the functionality of the AMORAI articles. Our invoice is at the same time the letter of guarantee. The beginning of the guarantee starts when the customer receives the goods ordered. A guarantee can be only applied, when the customer can show documents when the goods have been purchased/received.
Non announced and not previously agreed guarantee cases/return consignments will not be accepted.
No guarantee is applied to:

  • articles without documents like invoice, letter of delivery
  • wear, caused by normal, average use of the article
  • damages, caused by a non-appropriate storage of articles
  • wrongly and/ or improper used articles
  • soiled, damaged and incorrectly cleaned articles
  • changes of colours, bleached articles/fabrics caused by exposition to extensive UV
  • radiation, sun light
  • colour abrasion on printed materials. Specially on edges and on surfaces, caused by normal use of articles.
  • damaged bag-bodies, when damage was caused by inappropriate weight/load.
  • to everyone known "aging appearances" with tarpaulin, like: capillary cracks, breaks on covers
All goods in guarantee will be repaired or exchanged. We have the right do decide whether the article will be repaired or exchanged. Should the article not be available anymore, we offer an alternative to the client. The costs for sending the goods to us are paid by the client. The costs for returning the repaid/exchanged goods to the client are paid by ARPLUS AG.

REPAIRS BEYOND GUARANTEE

We do repairs of all AMORAI articles beyond guarantee in return of payment. As connoisseur of our articles, we know how to help a favourite item of a client. To avoid costs, we kindly asking the client to send us an e-mail with a photograph, so we can inform ourselves and send you a cost estimate. info@amorai.com

DATA SECURITY

All personal data supplied by the client are obliging us to data security. The data will not be supplied to third parties. We do guarantee a correct, careful and secure use of all data.

ADVANCE ORDERING

There is no possibility of advanced ordering or a reservation of a specific article. The client, who orders the article first, gets the article. (FiFo principal = first in, first out)
All goods are free to prior sale.

DELIVERY TIME

We specify delivery time with every in-coming order, separate. The delivery time is 10-30 working days, according type and amount of articles ordered. Our aim is to keep the delivery time as short as possible. Logistics needs 1-3 additional days, to deliver the ordered goods to the client, depending on destination.

CHANGEMENTS IN PRODUCTS

We keep the right to apply technical and design orientated changes to the articles, withouth prior notice. The changes can be done on a part or on the whole article. These changements are not all automatically presented/announced on the AMORAI-web page, respectively are not published on the web page, e.g. due to copyist protection.
We do not take guarantee for parts and materials of subcontractors others, then the ones, accepted by themselves.
Possible changes of product specifications we do communicate, when having knowledge of it, but not compulsive.
All product changes, adaptations we contribute are intended for increase quality and design and to serve the client.

COLOUR VARIATION

In textile business (synthetics or natural) it is possible, that the producers manage to have the same colour only in one production run. It is therefore possible, that there may be some variations in colour, when the fabric was not produced in the same run. If you place two orders of the same article within some time, it may be, that the goods have some colour variation, since the material has been produced by different production run.
But, please, realise there may be colour variations as well caused by different light conditions, when photographing, as well as not identical calibration of PC monitors. Placing bigger orders with us of the same article or of an article belonging to a product family, the client has to check for the exact colour, respectively to ask for a sample of colour before ordering. We can not be held responsible for any perceived difference between the photographs and colours of the real products.
